1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of rollIQ.io (the "Service"), provided by rollIQ.io ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

2. Description of Service

rollIQ.io is a dumpster rental management platform that facilitates connections between customers ("Customers") needing roll-off dumpster rentals and independent hauler companies ("Haulers") who provide the physical dumpsters, delivery, and pickup services. Our Service includes:

• Online rental inquiry submission and quote generation
• Project scheduling and dispatch coordination
• Billing, invoicing, and payment processing
• SMS and email notifications regarding project status
• Customer profile and project history management

3. Eligibility & Account Registration

You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Rental Inquiries & Quotes

When you submit a rental inquiry, we will use the information provided to generate a quote and coordinate delivery with an appropriate Hauler. Quotes are estimates based on the information you provide and are subject to change if actual project conditions differ (e.g., overweight loads, extra rental days, prohibited materials). Quotes are valid for the period stated on the quote and expire thereafter.

5. Rental Terms & Responsibilities

By booking a dumpster rental through the Service, you agree to the following:

• Rental Period: The rental period begins on the delivery date and includes the number of days specified in your quote. Additional days are subject to extra-day fees.
• Weight Limits: Each dumpster size includes a specified weight allowance. Overages are charged per ton at the rate in your quote.
• Prohibited Materials: You may not place hazardous materials, tires, batteries, paint, chemicals, asbestos, or other prohibited items in the dumpster. You are responsible for any fines or remediation costs for prohibited materials.
• Placement: You must provide a safe, accessible, and level location for dumpster placement. You are responsible for any damage to driveways, lawns, or property caused by the dumpster or delivery truck.
• Permits: You are responsible for obtaining any required street or placement permits.

6. Payments & Billing

Payment is due according to the terms stated on your invoice or quote. We accept credit cards, ACH, and other approved payment methods. Overages, extra days, and additional fees may be charged to your payment method on file. Invoices unpaid past their due date may incur late fees. Refunds, if applicable, are issued at our discretion and may take 5–10 business days to process.

7. Cancellations & Modifications

Cancellation requests must be submitted through the Service. Cancellations made at least 24 hours before the scheduled delivery date are eligible for a full refund. Cancellations within 24 hours or after delivery may be subject to cancellation or restocking fees. Service requests for pickup, swap, or extension are processed based on Hauler availability and are not guaranteed for same-day fulfillment.

8. Hauler Relationships

Haulers are independent third parties and not employees or agents of rollIQ.io. While we strive to work with reliable Haulers, we do not guarantee their performance, availability, or timing. We act as a facilitator and are not liable for acts or omissions of Haulers beyond our reasonable control. Disputes with Haulers regarding physical service delivery should be directed to us for resolution assistance.

9. SMS & Communications Consent

By providing your phone number, you consent to receive SMS text messages and automated communications related to your rental and account. See our Privacy Policy & SMS Consent for full details, including message frequency, opt-out instructions ("STOP"), and carrier fees.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Submit false, misleading, or fraudulent inquiry information
• Attempt to disrupt, overload, or gain unauthorized access to the Service
• Reproduce, copy, or distribute Service content without authorization
• Use the Service to send spam or unsolicited communications

11. Intellectual Property

All content, features, and functionality of the Service—including text, graphics, logos, software, and interfaces—are owned by rollIQ.io and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or content without prior written consent.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties regarding merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, rollIQ.io and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, property damage, delays, or business interruption. Our total liability for any claim shall not exceed the amount you paid us for the Service giving rise to the claim in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless rollIQ.io and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Austin, Texas. You waive any right to participate in a class action.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, all provisions that by their nature should survive termination shall remain in effect, including payment obligations and intellectual property rights.

17. Changes to These Terms

We may revise these Terms at any time. We will post the updated Terms and update the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
